Dylan Simmons Found Guilty of Second-Degree Murder Without Intent of Darisha Bailey Vath

Stillwater – A jury in Washington County Thursday morning found Dylan Simmons of North Branch, MN, 21, to be guilty of second-degree murder without intent in the death of 17-year-old Darisha Bailey Vath on July 16, 2023.
Simmons was found guilty on five of the six charges levied against him by the State of Minnesota. He was found not guilty of second-degree murder with intent, the most consequential of charges levied against him. The other charges Simmons was found guilty of were criminal vehicular homicide where the driver who caused the collision leaves the scene and three counts of assault in the second degree with a dangerous weapon.
Based on state guidelines for sentencing, Simmons could receive a sentence of 10 and a half to 15 years in prison for his convicted charges.
Simmons rejected a plea deal on April 26 this year, leading to this jury trial. With the jury trial over, Simmons still has an active warrant on two additional charges against him in Chisago County from July 15, 2023, the night before Bailey Vath died.
The charges are aiding and abetting, attempted assault-1st Degree-great bodily harm, and aiding and abetting assault-3rd degree-substantial bodily harm. It is unknown at this time if the two charges in Chisago County will remain or be dismissed following the outcome of this trial.
Simmons’s sentencing is currently scheduled for March 20, 2025, at 1:00 p.m. Simmons has been ordered under Judge Siv Mjanger to be held without bail or bond. More updates to come…
